What if someone is using my trademark?

If you have rights to a trademark, either through common law use or through an actual trademark registration, you can take action against a person or company who is using a name or logo which is likely to cause confusion with your trademark.

Their use of the mark does not have to be identical to your trademark, but rather, if it is “confusingly similar” to your existing trademark, that is – is it likely that consumers will believe that your products and services are related or from the same source, you may have a valid trademark infringement claim.
