Descriptive trademarks are words or designs that merely describe the products/services that the trademark represents.

Examples of descriptive trademarks are: “ALL BRAN” for bran cereal, or “KENTUCKY FRIED CHICKEN” for fried chicken.

Descriptive trademarks may be allowed to register on the Supplemental Register of the USPTO, but they will have limited protection, as they are merely descriptive and not distinctive enough for full trademark protection.

Descriptive trademarks which have “acquired distinctiveness” over time may be registered on the Principal Register.

We do more than just helping you fill out a form! We provide legal advice as to the strength of your mark and help you register the trademark right the first time.

Let’s get started so you can prevent others from profiting from your trademark. Call 716853111 to speak directly to trademark attorney Erin Gormley.
