Question of the Day: Is it ok if my competitor has a trademark for "Your hot" for me to use the same phrase but spell it "Your H.O.T.?" The product lines are the same. Or is this trademark infringement?

The purpose of trademarks is to prevent consumers from being confused about the origin and qualities of the products and services they’re buying. You can’t have a trademark that’s only slightly different from your competitions – such as a trademark that is spelled differently but sounds the same.

It is perfectly legal for two companies in completely different industries to use the same trademark – like Delta Airlines, Delta Dentist, and Delta Faucet. No one is going to be confused and think that these all come from the same company.

If legal questions were easy, we wouldn’t need lawyers.
