Based on over 20 years handling complex i601a cases, immigration attorney Carlos Batara prepared this series to share secrets for demonstrating extreme hardship over that period: https://www.bataraimmigrationlaw.com.

Part 1 of this series provided a general overview of the process for proving extreme hardship for an immigrant spouse. Four secrets of practical evidence advice necessary to ensure your i601 waiver is approved were introduced.

Part 2 went into more depth on how to develop evidence to improve your chances for success. It laid out how to transform evidence of an ordinary hardship into proof of an extreme hardship. It focused on the difference between direct and indirect hardship sources, as well as the distinctions between family members who are qualifying relatives and those who are not.

In this video, the focus remains on the specific of evidence preparation for proving extreme hardship in i601 inadmissibility waiver cases. Three primary items are discussed.

First, the three rules for evaluating extreme hardship that USCIS officers and immigration judge must follow in I 601 cases.

Second, how these three rules lend themselves to building mini hardships. (The indirect and small “h” of nonqualifying relatives.) This effort of starting small and growing larger can be likened to collecting pebbles of evidence, which together turn into a monumental, bigger hardship. (The big “H” of qualifying relatives.)

Third, the importance of storytelling as a vehicle for presenting your evidence in a comprehensive and cohesive manner, facilitating thorough review by adjudicators.

Storytelling enables i601a hardship applicants to outline positive reasons to get an i601 waiver approved, and not simply discuss in a rudimentary and sterile style why they meet the regulatory requirements. It allows immigrants to illustrate how they are making the U.S. a better country, factors which are overlooked in robotic formulas for preparing extreme hardship waiver applications.

The purpose of this threepart video series is to share tips and insights for evidence preparation, evidence development, and evidence presentation not discussed by immigrant advocates and legal representatives. In so doing, the process of earning a green card through marriage for an immigrant spouse becomes more likely and within your grasp.
