Florida’s adoption of the federal summary judgment standard is important to understand. Typically, the federal standard has been interpreted as giving much more deference to the trial Judge. In this episode of Florida Appeals Journal, Jennifer Carroll explores an important 2014 case that offers a very good analysis and summary of how summary judgment should be applies. Further, she recommends other considerations to be aware of if you are dealing with a case in which a motion for summary judgment has been entered.
