Divorce: How Does Alimony Work in Florida

There are a lot of common misconceptions when it comes to alimony after divorce in Florida. In fact, even some professionals get it wrong.

There's no denying it, divorce in Florida can get complicated, messy, and stressful. Luckily with Leap Frog Divorce, it doesn't have to be that way.

In order to determine alimony amounts in Florida you have to look at each individual case. Just because people get divorced does not always mean that one spouse or the other gets alimony. It just doesn't work like that. People often think that alimony's goal is to make the spouse's income equal but the truth is that if neither spouse needs alimony, neither spouse will receive alimony.

Alimony would come into to play if one spouse falls short at the end of the month and cannot afford essentials like bills, food, water, etc. Another consideration would be whether the other spouse can actually provide the alimony support.

Occasionally a couple will find that neither one is really 'owed' support but a judge will grant something called 'nominal alimony' which equates to $1. Then, if circumstances change, alimony will be awarded based off a reconfiguration of finances.

There are a variety of other factors that influence alimony in Florida. It's too vast to explain in one video, but some other considerations are whether one or the other parent gave up a career to be a stay at home parent. A stay at home parent is a 24/7 job that receives no compensation and is rarely valued the way that it should be. Raising children is considered a contribution to a marriage and is definitely a deciding factor for a judge.

We'd also like to address a myth that circulates in Florida (including among professionals) and that is that there's a set amount of alimony (standard alimony) of a percentage of income. That is simply not the case. Each situation is unique and each situation will be calculated accordingly by a judge.
