What is 'the Rule' for witness testimony in Court?

Matthew Harris Law, PLLC

If you are asked to testify in Court, you better pay attention because you may hear one party invoke “The Rule.”

There are lots of rules in court, but somehow, this one became known as “The Rule.”
If one party invokes “the rule” then you’ll hear the Judge instruct you to leave the Courtroom, and to remain outside during the proceedings.

You’ll also be instructed not to listen to the testimony of any other witness, or to discuss your testimony with any person, except the attorneys.

If you violate the Judge’s instructions, then you may be completely excluded as a witness in the case.

Additionally, you may be held in contempt for any violation, which could include a monetary penalty up to $500.00, confinement in jail up to 180 days, or both a fine and confinement.

For those of you still reading, this is also known as Witness Sequestration.
