A Provisional Patent Application is NOT a patent application!! It never gets examined by the USPTO and it expires in 1year! To obtain patent protection, a utility patent application (i.e. a REAL patent application) must be filed within 1year of the filing date of the Provisional Patent Application in order to receive the benefit of the Provisional Patent Application filing date.
