Question of the Day: What can an individual can expect to own the rights to, even if they’re employed when they develop, invent, or create something?

All the inventors of an inventions must be listed on the patent application to the U.S. Patent and Trademark Office. Being listed doesn’t mean they own it. Many companies require employees to assign the rights in everything they create during their employment to the company.

If you’re an employee, your employer is the author of, and owns the copyright in, everything you create in the scope of your employment. (The rules are different if you’re an independent contractor.)

If you signed a noncompete agreement as part of your employment, you might not be able to work on the same type of project in your next job without risk of violating this contract.
