It's really simple:

This question is always asked in the context of some "thing" or "process" that is said to be "patent pending" . . .

So "Patent Pending" simply means that either a provisional patent application or a utility application has been filed that MAY protect that thing or process.

It does NOT mean that it's patented, or protected, or that a patent will issue.
