Trademark Oppositions: What Are They and What You Can Do

Trademark Oppositions, though rare are powerful.

For a trademark application, following the Examination by the Trademark Office, there's still one more examination to go: the public gets to 'examine' the mark to see if anyone has objections to its allowance. These public objections are asserted by a process called "Opposing" the mark.

The most common objection is that the pending mark will DILUTE the scope of an existing mark.

If you are a trying to get your trademark registered, an opposition can hold your mark up for months even over a year and may prevent you from getting your trademark allowed at all. It can also cost a lot of money.

If you are a trademark owner, an Opposition may be your best chance to point out to the Trademark Office that they failed to consider something important when examining another mark.

Trademark opposition proceedings are procedurally intensive, and should not be handled by anyone who's not deeply familiar with US Trademark Office procedure and US Trademark Law.
