Patentability - Invention Analysis; Determine the novel aspects of your invention

Follow
Patent Insanity

When preparing to file a patent application with the United States Patent and Trademark Office (USPTO), you or your patent attorney have to perform invention analysis. Invention analysis means you must determining what the actual invention is and the "novelty nugget" that will form a
novel claim limitation in your broadest patent claim. As you add limitations to your claim, the claim becomes narrower which may make the claim more "patentable." However, the narrower the claim, the easier it is to design around to avoid infringement.
