How to Describe Goods and Services in a Trademark Application

Follow
Gerben IP

One of the most critical sections of a trademark application is describing the goods and services you plan to offer under your trademark.

This question is so important because it sets the rights and scope for your trademark protection.

Under U.S. trademark law, any trademarks you register will be protected within only the categories you list in the goods and services section of your application.

For example, compare Dove Chocolate and Dove Soap. One is a chocolate maker; one is a soap company. They each have the "Dove" trademark because their registrations are for different, unrelated goods.

Understanding how to properly describe your goods and services in a trademark application can be challenging, so consider the three tips provided in this video when completing the section.

1. List the products or services you plan to offer in layman’s terms.
2. Be realistic, and not aspirational, in your list.
3. Understand the USPTO’s technical language requirements.
