What is the “judicial power” as defined by the Constitution?

Professor Gary Lawson discusses how the judicial power was historically held by an executive. It did not exist as an independent entity in any previous form of government. This makes it often difficult to distinguish the judicial power from executive or legislative powers, although the separation of these three powers in crucial to our Constitutional government.

Professor Gary Lawson is the Philip S. Beck Professor at Boston University School of Law.
