A herniated disc in your spine resulting from a work injury can greatly increase the settlement value of your case. However, you cannot assume that your employer and their insurance company want to deal with the implications of a disc injury.

As I discuss in this video, there is no way to know for certain that you have a herniated disc unless you have the right type of test usually an MRI, a CT scan or a discogram. Insurance companies do not like to pay for these expensive tests, and they may push back on your efforts to obtain one of these tests because a definitive finding that you have a herniated disc means more financial exposure for them both in terms of #temporarytotaldisability benefits and when it comes time for #settlement.

As the injured worker however, you need to know as soon as possible that you have a disc problem since early treatment can produce better results for you.
