Here's another Trademark Health Tip from the Trademark Doctor.

People want to know, "Do I need to register my trademark to protect my brand?"

No, you don't have to register your trademark.

Just by using your trademark, you have common law trademark rights.

You have those rights in every geographic area where you are using that trademark.

If you are the first user of the mark, then you have the rights to use that mark exclusively on your goods or services.

And you can sue in court to make others stop using your mark on similar goods and services.

But, beware! By not registering your mark, you can cause yourself a lot of problems down the road.

I like to say that unregistered trademarks are bad medicine. They look inexpensive, but when you have to enforce your trademark, it can be expensive to hire a lawyer and prove that you were the first user of the mark.

So I prescribe a trademark registration if your mark is important to your business.
