There are no depositions.There is no fighting the charge.There will be only one continuance.The client/defendant must be eligible to enter a PreTrial Intervention Agreement or Deferred Prosecution agreement or be willing to plead guilty to the crimes charged in an effort to resolve their criminal case.This is referred to as Plea bargaining or resolving your case.Plea bargaining can mean several things: a) Deferred Prosecution Agreement, b) PTI, c) pleading guilty to the crimes charged, d) admission to a VOP charge.If eligible on a misdemeanor charge most defendants will want to seek a deferred prosecution agreement wherein they are required to complete certain tasks during a set amount of time in exchange for dismissal.If successful the state prosecutor would dismiss the case.Not all defendants will be eligible nor will all misdemeanors be eligible for Deferred Prosecution.PreTrial Intervention Program or PTI is similar to deferred prosecution but applies to third degree felony cases.The conditions tend to be more involved and the length of time is significantly longer as most programs are one to two years in length. A PTI program may be 18 months and require a theft class, drug classes, evaluations, no contact with victim, community service hours, restitution payments, etc.Successful completion of PTI results in a dismissal of your case.Pleading guilty to the charges involves acknowledgment and admission of your guilt to the court.Individuals that are alleged to have committed crimes that are not eligible for a DPA or PTI may want to plead guilty and resolve their case. Individuals that are not eligible based on their prior criminal history or lack of victim consent may plead guilty to the charges to reduce the amount of probation or incarceration they receive.The goal in plea bargaining is to not receive the maximum punishment but come to an agreement wherein the defendant admits culpability and is given a lesser punishment.Admission to Violation of Probation (vop)Plea bargaining a VOP means admitting the violation and negotiating with the prosecutor or judge regarding the punishment.You admit you violated your probation and are punished for the violation.Plea bargains can result in conviction and incarceration.This is an effort to provide legal representation at a reasonable fee to those that meet the criteria above.For more details call 5617467076
